Prices are F.O.B. TSC Nursery Sales Ltd., Richmond, B.C., unless other wise agreed in writing. All customs and phytosanitary inspection fees for shipments outside of Canada are the responsibility of the customer.
New Accounts: C.O.D until credit application is approved.
TSC Nursery Sales Ltd. guarantees all stock to be alive and in good condition when shipped from our nursery. In addition, TSC Nursery Sales Ltd. guarantees that all nursery stock shall be as named and if satisfactorily proven otherwise, the stock will be replaced or a refund will be issued at the discretion of TSC.
Liability, in all cases, is limited to the payment originally received for the nursery stock. No guarantee, expressed or implied, will be given concerning the productivity of any nursery stock sold.
TSC Nursery Sales Ltd. will not accept responsibility for plants whose root balls have been tampered with or damaged (i.e. cut strings, wires or removed burlap) at the time of planting.
The customer must inspect their nursery stock upon arrival. Claims for any cause must be made in writing, within 3 days of receiving the stock. Valid claims will be processed immediately. TSC Nursery Sales Ltd. will not honour claims for goods that have previously been accepted unless they are found not to be true to name. TSC Nursery Sales Ltd. will only be responsible for claims from the customer, not any other party, and will only be subject to conditions set in this document.
On all public carrier shipments, it is the responsibility of the recipient to check the condition and count the nursery stock received. All claims should be made in writing on the Bill of Lading upon receipt of the shipment. A copy or notice of the claim should be forwarded to TSC Nursery Sales Ltd. within 3 days following the arrival of the stock.
TSC Nursery Sales Ltd. accepts all orders without liability for consequential damages due to, hail, frost, flood, fire, transportation delays, and other causes beyond our control.
Unfortunately, due to the regulations and concerns regarding Phyophthora ramorum (Sudden Oak Death), TSC is no longer able to accept plant returns after they have left the nursery. Please ensure that due care is taken when placing order quantities.
